1. Scope
This notice describes personal-information processing when visitors browse the corporate Modu Mayo website, contact us through email or WhatsApp, and, if enabled in the future, submit a partnership enquiry. It does not govern all operational records of every Group company. Where a particular operating subsidiary collects data for customer trading, logistics, recruitment or finance purposes, an appropriate entity-specific notice or supplemental disclosure may apply.
Modu Mayo Group decides the purposes and means of processing for the Group website. Relevant enquiries may be shared with authorised Group personnel or the operating entity best placed to respond, strictly for the disclosed purpose. Any recipient remains responsible for complying with the obligations applicable to its handling of personal information.
2. Information collected and sources
You provide: name, work or personal email, telephone number (optional for the future partnership form), organisation (where relevant), partnership category, proposal details, and anything you choose to include in an email or WhatsApp chat. When a customer starts a trade discussion over WhatsApp, additional order information may be processed by the actual TradeCo seller under its separate commercial arrangements.
Automatically or through service providers: technical data needed to deliver and secure the website, potentially network and device identifiers, IP address, timestamps, errors, request metadata and security-verification information, depending on the services actually configured.
We do not request identity documents, banking credentials, health records, children's information or confidential business plans through initial email or WhatsApp enquiries. Please do not provide these; if received, we will follow a lawful handling and deletion/escalation process.
3. Why information is used and lawful justification
| Activity | Purpose | Potential lawful justification (depends on circumstances) |
|---|---|---|
| Reply to a general, trade or partnership enquiry | Communicate, evaluate whether there is a fit, arrange human follow-up | Necessary steps requested before a potential agreement and/or legitimate interests under POPIA s11, depending on context |
| Route the enquiry internally | Give it to an authorised Group operating function | Proper performance of the stated enquiry purpose, with appropriate sharing controls |
| Operate and secure the site | Prevent abuse, investigate failures, maintain service | Applicable legitimate interests and/or obligations under law, subject to necessity and proportionality |
| Keep limited records | Continuity, accountability, legal disputes or compliance | Applicable contractual needs, legal obligations or demonstrated legitimate interests |
| Direct marketing (not enabled by this website form) | Optional promotional messages | Separate valid permission or limited existing-customer conditions under POPIA s69; a partnership enquiry alone is not marketing consent |
4. Mandatory and optional details
For Phase 1, visitors may contact Modu Mayo by email or WhatsApp. Supply only enough contact and enquiry details for an appropriate response. The partnership web form is not active; any future form will describe its required fields.
An acknowledgement that you have read this notice is not a blanket consent to unrelated processing or marketing.
How the enquiry is handled
This is a corporate information and contact website; there is currently no online checkout, account registration or automated financing decision. General email enquiries are addressed to the Group, while current bulk-food customer negotiations and accepted orders must be handled by the actual TradeCo contracting party through its own lawfully approved terms and records. There is currently no active partnership web form.
We may ask follow-up questions directly relevant to an enquiry. We will not make a lending or franchise decision simply by receiving a message. Do not supply identification documents, bank statements, account passwords, sensitive personal information or third-party confidential information through these initial channels.
When and how you are told
This notice is linked from the website, including the Contact and Partnerships pages. If we receive personal information indirectly, such as through a referral, we will explain the relevant processing where required and apply applicable notice and lawful-processing requirements.
5. Recipients and processors
Information may be accessible to authorised Modu Mayo Group personnel and, where relevant to the enquiry, its operating businesses, subject to purpose limitation. Service providers may include:
- Afrihost / hosted mail infrastructure: receiving and sending business email, and mail storage.
- Vercel: website hosting, deployment, request and security operations and privacy-focused, aggregated website page-view analytics.
- Cloudflare Turnstile: security verification only if the form is activated.
- Email clients: authorised personnel may use mail applications to access business correspondence.
- Meta / WhatsApp: communications where the visitor initiates a WhatsApp chat.
The services listed above are relevant only where used. We do not represent that every provider stores data in South Africa.
6. Transfers outside South Africa
Personal information may be processed outside South Africa by infrastructure, security and messaging providers. Where POPIA s72 applies, an appropriate lawful transfer condition and safeguards must be in place.
7. Retention
We keep information only for the purpose for which collected and lawful related retention needs, then securely delete, destroy or de-identify it as appropriate. Retention varies by purpose, legal obligations and the need to resolve enquiries or disputes.
8. Security
We use measures proportionate to the information and risks, including controlled account access, secure transport and security review. No electronic system is guaranteed absolutely secure. Security incidents involving personal information will be assessed and notified where required by law.
9. Your rights
Subject to POPIA and PAIA, you may ask whether we hold personal information about you, request access, correction or deletion where applicable, object to qualifying processing, or withdraw a consent where consent is relied upon. We may request proportionate identity verification before disclosing records.
Privacy and personal-information requests may be directed to info@modumayo.co.za or 066 413 3763 as the main telephone. For complaints, you may approach South Africa's Information Regulator: https://inforegulator.org.za/ or https://eservices.inforegulator.org.za/.
10. Unsolicited electronic marketing
We do not interpret a general enquiry as permission to send unrelated promotional communications. If we introduce newsletters or outreach, we will apply the lawful consent and existing-customer restrictions and provide an accessible opt-out as required.
11. Other websites, email and WhatsApp
When you click a WhatsApp, email or other external-service link, your interaction with that service is subject to its own terms and privacy arrangements as well as any information subsequently processed by Modu Mayo. This notice does not claim control over third-party services.
12. Cookies and similar technologies
This website does not include advertising scripts or general-purpose Google Analytics scripts. We use Vercel Web Analytics to understand aggregate website visits and page views, such as popular pages and referrer sources. Vercel states that this service operates without analytics cookies; it processes limited visit and technical data to produce its reporting. We do not use Web Analytics for targeted advertising or visitor-specific marketing. Hosting and any enabled security services may use necessary cookies or technical identifiers.
13. Entity and legal-rights boundaries
This notice covers processing controlled by Modu Mayo Group (Pty) Ltd for the Group website. An operating subsidiary must assess and notify on its own collection or contractual processing as applicable. An enquiry is not an automatic customer order, supplier agreement, funding award or franchise approval. We do not ask anyone to waive non-excludable POPIA, PAIA or consumer rights by acknowledging this notice.
This notice does not waive statutory rights or establish email as the exclusive lawful method of serving legal proceedings. Confidential requests are evaluated case by case under applicable law and records are shared on a need-to-know basis.
14. Changes
We may update this notice when relevant business, legal or technology changes occur. Material changes affecting processing will receive appropriate fresh notice and review.
